What is Mediation?
Mediation is a wonderful alternative to traditional conflict resolution. Whether it be divorce, parenting time, neighbor to neighbor, workplace disputes or any other matter, I believe that there is always a better way to work things out than battling in a courtroom. Between attorney’s fees, court fees and the slow nature of the judicial process, litigation can take an enormous amount of money and time. Mediation can help you reach an agreement in a much shorter period of time, spend much less and allow you to keep the decision making power throughout the entire process.
In many cases, relationships need to be preserved, especially in the case of parents who are raising children although they are no longer together. I have mediated more than 900 domestic cases, and found that in most instances, parents can reach a mutually beneficial agreement if they can come together and discuss what is best for their kids. This process often leads to a more civil and relaxed relationship between the parties going forward. I can help you to create a clear Parenting Plan in both English and Spanish, do child support calculations and provide everything you need to file your agreement with the court, making it a binding court order. In civil disputes, I can help facilitate a respectful dialogue, negotiate a mutual agreement and create and MOU or memorandum of understanding that will be a binding contract between both parties. Mediation is a completely voluntary process, unless it is court-ordered and even then, resolution is up to you. There is always time to fight out your differences in a courtroom, but why not try talking it out first? Mediation may be the best solution. * It is important to understand and keep in mind that mediators are not attorneys and cannot provide legal advice. While attorneys are not required for mediation, we strongly recommend counting on your legal advisers when making major decisions. |
